Wouldn't put much hope in a recovery from the class action. Was involved in a real one once against AMD. They had them cold. Not like ABTX where a real cause for action seems ambiguous.

Anyway, played the class action suit. Sent different forms by request 3 or 4 times to the class attorneys over as many years. They had the settlement in escrow for 2 years. After the attorneys ate off the funds for all that time, I got a check after 4 years for about 1% of what I lost.

Class action suits, without truly egregious behaviour by the company, are a lousy way of making up for your mistakes and provide nothing but money for lawyers by and large My advice is to let the company focus on building the business. In the long run you will have an infinitely greater chance of recouping......YMMV

The management clearly needs to get its act together. What many people choose to forget is that this company was put together at breakneck speed -- we got spoiled, and the failure to see a buyout only rubbed salt in a lot of wounds. It now seems time to adopt the strategy of the tortoise and let the management do its job. For those of you who thik joining the suit will help, you're right. It'll help the lawyers get richer, the company get bogged down and you'll get to tell your friends how much you've grown as a person for standing up for your rights. But you'll still need another buck-twenty five for a subway token to meet them.

BTW...Since you mince words in your post, "a deal is in the works..." isn't the same thing as "a deal is done."
