Judge considers recess after testimony

The judge in Microsoft's antitrust trial has told lawyers he wants the software giant
to wrap up its defense by month's end and he then may call a recess that could
postpone the conclusion of the case until mid- April.

U.S. District Judge Thomas Penfield Jackson, in a private conference with lawyers
yesterday that was made public today, noted that Microsoft has seven more witnesses to
call before completing the main part of its defense. The judge also will allow each side to
present two rebuttal witnesses in the trial, which began October 19.

He signaled yesterday that he was likely to grant up to a one-month recess once Microsoft completes its defense to accommodate vacation and trial schedules of lawyers on both sides. He then would reconvene the trial for the rebuttal witnesses and closing arguments. That could mean the trial would end sometime in mid-April and Jackson then would begin his deliberations before reaching a decision.
