LAWSUIT UPDATE remember, I'm not a lawyer like MIKEY, this is just what I have read from the filings. The 90 day "decision" by the judge was entered 10-30-98. 90 days hence was 1-28-99. The court set a hearing for that date. Later (on 12-23) the court pushed back the hearing from 1-28-99 to 1:30 PM 3/4/99 by agreement of the parties. I have copies of the above two court orders along w/pleadings 71-82 (except for 78 for some reason). AOL delivered its response to BNEZ interrogatories 12-17. BNEZ has filed a motion for discovery of everything you can think of, i.e. the entire kitchen not just the sink, related to the limited discovery items permitted by the judge. They want AOL to provide mucho stuff. This in order to be prepared to depose the people they plan to depose. Naturally, AOL is taking issue with this. And, naturally BNEZ is fighting back. Last filing I have was #82 which was filed 1-6-99. so know I guess it is wait and see until march 4th, and then the Judge will probably take the filings off to study and then make a decision 30-60 days after that, so around May 1st from my guess on whether he will dismiss the filed motion of dismissal from AOL to BNEZ and then HOPEFULLY SET A COURT DATE. ALSO, pleading 83 is confidential, MUST BE TOP SECRET STUFF LIKE DEPOSITIONS FROM AOL OR THE FILES ON THE KENNEDY CASE mitchell
