Any product can have probable deaths and maimings- how safe is safe? All companies do risk/reward assessments- some of them are a bit more egregious than others- GM, the tobacco companies, the asbestos companies. Almost all drugs have a probability of killing someone- so where do you draw the line? Must companies choose the safest design? How would you regulate such a thing (answer- you couldn't and the results would be horrendous if you tried). The answer under our system is legal redress in the courts. So I would side with GM's right to choose to do what it did- but if I were on the JURY I would award a big benefit to the plaintiffs- its all a matter of procedure- I am a big fan of following the rules, no matter how silly and tortuous they might be.
