This is a good lawsuit. There are so many abusive ones (the guy who is suing Ameritrade, because they "let him use margin, and he lost money"). But this one is right on. It is one thing to have technical problems that are not your fault - external phone lines go down etc. It is quite another, if you take on extra customers, when the capacity of your system is clearly going to be overloaded, based on objective technical specifications. In that case you already know ahead of time, that you will provide unsatisfactory service that could result in financial losses. Datek, take notice.
