The issues raised are as thorny and as serious as you state. I see them as serious as the Jews under Nazi law--not that this incident carries that weight.

The right of the President to execute this assessment comes under Amendment 9&10. Sex is no where else specifically mentioned, and so, therefore excluded. [This would seem less trivial if it were the specified excluded of Amendment 1, but this is the case before us.]

As mentioned, it was the Discovery process that was doing the damage; appeals would have allowed the damage to have already occured. What I propose is unclear, secrecy may be some remedy, but more than current. A redone discovery process, ... .
