Mr. Boies also offered into evidence Tuesday, over sharp objections by Microsoft, a 1990 Microsoft memo that appears to propose a deal to divide the market for personal-finance software between Microsoft and Intuit Inc., the market leader. Microsoft's lawyer called it "far beyond the scope" of the testimony at hand; Mr. Boies insisted that "it goes to Microsoft's overall pattern."
