"Five-Year Tax Holiday"

Section 94 of the Income Tax Act provides for an effective offshore tax structure for individuals planning to immigrate to Canada and their immediate family. The assets in an immigration trust can earn income and capital gains from foreign sources — without triggering Canadian income taxes — for up to the first five years that the immigrant resides in Canada. The trustee (and protector, if one is appointed) for the trust must be nonresident in Canada. The tax holiday ends at the start of the taxation year in which the settlor has been resident in Canada for more than 60 months. When the tax holiday ends, the trust's income will generally taxable in Canada as foreign accrual property income. To avoid this, the trust can either be immigrated to Canada or it can be wound up. The author discusses both scenarios and provides examples of the tax savings that can be realized.
