When you read Shiva's response pertaining to WHEN Shiva was offered 9 5/8...they have a problem. The lawyers heading the class will pick up on it if they haven't already. ( Heads up Mark F. ! )
Shiva says that NT offered 9 5/8 in 12/97 for all of Shiva stock.
Well, 12/97 was only the beginning of their negotiations with NT.
Some 9 to 10 weeks later into Q1 98 culminated the 80 mm OEM deal between them. At THAT POINT. Shiva stock was over 14 bucks a share.
How odd would it be that NT only sought a deal in the BEGINNING of their talks but NOT during the middle or END when the stock was in the lower teens ???
I wonder what kind of deposition NT would make about those events.
Needless to say, Zucco et al, said NO to NT and YES too Intel barely 2 qtrs. later.
THAT STINKS....And the lawyers will catch it.
