Anyway, what does the license agreement say? It says return it to to where you purchased it from. Meaning return in to the computer dealer, not to MS.

Who are barred from giving refund by MS.

Furthermore the license agreement is with MS, not the OEM. Therefore, returning it to the OEM is merely a distribution mechanism for the refund. MS is the one that contractually owes the refund. Read the EULA.
