Qualcomm and Ericsson Trying to Settle Patent Suit, Paper Says


San Diego, California, Feb. 18 (Bloomberg) -- Qualcomm Inc. and Ericsson AB are trying to settle a
dispute over cellular phone-technology patents out of court before a jury trial begins April 6 in
Marshall, Texas, Investors Business Daily said. Ericsson sued Qualcomm in September 1996,
alleging patent infringement on a cellular-phone technology called CDMA, and if the suit is settled
before trial, it would resolve all outstanding issues, said Qualcomm President Richard Sulpizio.
Ericsson would like to settle the suit with a cross-licensing agreement for CDMA, said Ericsson
general counsel Larry Lyles, and the company's U.S. Chief Executive, Bo Dimert, told the
newspaper ''we're optimistic we can settle these things.''

In October, Qualcomm said Ericsson dropped claims against the company for three patents in the
Texas lawsuit, and also surrendered its rights to two separate patents it disputed. (IBD 2/18 A6

Marvin: Isn't this the crux of the argument...
"Q has to signal in strongest terms that Erricson etc are playing with an empty deck ie IPRS."

It seems that may be the problem, they can't and hence why they are negotiating.
