Nice post, Trufflette. I'm among the many who don't fully understand the process that Mr. Softee is going through, and your comments are a big help.

A judge may appear biased on the surface to a party who is not doing well in the trial (although I doubt most competent federal judges would appear so) but he knows his rulings will be reviewed by a court of appeals and I doubt that many want to be professionally embarrassed by having key rulings overturned in a high profile trial like this one.

Correct me if I am wrong, but I am under the impression that this particular judge ruled against Microsoft in the recent past and was overturned on appeal. It has been suggested that he was embarrassed and hostile towards msft as a result. If this is true, it presents a considerable hurdle for Mr. Softee.

Thanks for your expert comments. Based on what I heard so far, the most likely outcome in the end is a slap on the wrist to MSFT by telling MSFT Not TO Do It Again (stuff like that). In the mean time, MSFT is marching along with new products release and earning surprises. I consider that to be a big victory for MSFT and millions of MSFT shareholders, especially those who bought at the dip.
