Is your shooting an accusation? verdict? truth? It was indeed harmful, if proven. [Attempt to...] If unproven, then yes the system should look the other way, NOT, as with BC, create punishment. Worse than punishment for unproven harm, is creating wrong and punishing where proven unharm.
