Trials are meant to determine disputed matters of fact, and to air controversies about the application of laws. People subject to trial may be guilty or innocent. That is what the trial is there to determine. For it to be fair, and to complete its business properly, there must be cooperation from both sides. Otherwise, we may as well dispense with trials altogether. Would that be better? The likely result is that we would "just hang 'em".
