BII's application to the SEC specifically states that they have applied for NASDAQ National Market. My guess is that they found a way to enter the National Market based on the $4 standard as specified in the listing requirements. I know that the standard was adjusted to $5 in the latter part of last year but the listing requirements also state that consideration will be given on waving any of the listing requirements based on the quality of the other qualifications.

My guess, and its only a guess, is that they have had discussions with NASDAQ about entering National Market considering their current market cap.
