This is why you see disclaimers such as " Keep disk out of drive when not in use " .

I can see a class action suit , some time in the future , against Iomega based on disk problems due to operator error or mishandling if Iomega didn't warn against the potential problem .

Looks like a disclaimer to me ,

I agree with you completely. Obviously, if Clik! were so fragile that it couldn't realistically be used in the field, it wouldn't have made it past alpha testing.

Those who have actually used the drive have had good things to say about its construction. So why should anyone believe baseless allegations from someone who has never had a good thing to say about any Iomega product?
