Some people, especially those with expertise in software intellectual properties, are of the opinion that although Microsoft may have been humiliated, it certainly has not been defeated.

Undeniably David Boies, the attorney representing Uncle Sam, has done an excellent job of discrediting several of Microsoft's witnesses. Yet there seems to be enough flexibility in the antitrust law--and enough uncertainty about how it can apply to a dynamic, high-tech industry--that the final outcome could go either way.

Mary Meek's (of Morgan Stanley?) prediction that MSFT would get a slap on its wrist (at the very worst) seems overly simplistic to me. We shall see before too long.
