If they hadn't mounted any defense at all, and just said the government hadn't proven its case, wouldn't they be better off on appeal? They'd certainly look better from a "hearts and minds" viewpoint.

I can't dispute the "hearts and minds" point.

As for the rest, I think that, to make someone overplay their hand, you have to make them really over confident. You have to try to create psychological pressures and momentum that will drive them inextricably to the wrong choice.

I'm not sure just resting their case without putting on a defense would have done that.

And I'll be the first to admit that I could be wrong. The conspiracy theorists may now have something to talk about in this case ("Watch out for the lawyer behind the grassy knoll!" ;)), but usually, for any given event, the simplest, most obvious explanation is the correct one.
