Selling stock that you dont have or that hasn't been borrowed could subject one to fines and or restrictions by the SEC or your broker

From Etrade:
Short Sale Requirements

You must have a margin account. Please see The Margin Account.

***** E*TRADE must be able to borrow the shares for you in the first place.

The security being sold short must be a marginable security valued at $5 or
more per share.

The trade can be executed only after an uptick (or zero-plus tick for listed stocks).

I'm pretty sure both rules in bold have SEC origins

From ETrade help desk regarding short sells:

Warren E*TRADE C/S
If you sell securities in your account without entering it as a short sell, and the order executes, you'll be in what's called a "sold-not-long" violation--and will have to buy back the shares immediately.



I also understand any profits from the transaction are withheld.
