If the two sides are talking, they will settle. At this point it is in the best interest of both sides to find a middle ground.

The DOJ really cannot afford to let MSFT off the hook "ala Clinton" and "ala OJ". On the other hand, MSFT cannot afford to have the DOJ telling them how to run their day to day business.

As good as the DOJ's case looks right now there's no guarantee they will win, just ask Chris and Marsha. Likewise, MSFT is not guaranteed a repreive at appleals level either.

If this rumor about MSFT and the DOJ talking is true, they will settle.
