Qualcomm, Ericsson Say Patent Trial to Be Postponed (Update2) (Adds Qualcomm no comment on talks in 8th paragraph.)
San Diego, March 2 (Bloomberg) -- Qualcomm Inc., a cellular phone and network equipment maker, said a trial set for April 6 over a patent suit filed by rival Ericsson AB, the world's No. 3 mobile-phone maker, probably will be postponed until early June.

Qualcomm said it expects the U.S. District Court to issue an order this week setting out the revised scheduled. The judge hearing the case in Texas indicated Friday that the start date will be moved back two months, the San Diego-based company said.

Ericsson filed the suit in September 1996, claiming a new standard for digital cellular networks developed by Qualcomm violated Ericsson patents. Qualcomm countersued, claiming Ericsson's suit was invalid and anticompetitive. The trial is being postponed due to the complexity of the case, Ericsson spokesman Kathy Egan said. ''The special master appointed to evaluate the claims wants to evaluate a large amount of information,'' Egan said.

A special master is a court-appointed official who assists judges in highly technical cases.


Last month, the Wall Street Journal reported that the companies were close to a settlement, saying they were about to sign an agreement allowing each to use the other's technology. ''It would be natural to be talking,'' Egan said. ''It's always preferable to negotiate rather than litigate.''

Qualcomm declined to comment on whether talks were being held or the reason behind the expected postponement.

Qualcomm shares rose 1 3/8 to 73 3/4. Ericsson American depositary receipts fell 1/8 to 25 11/16.
