Maybe this lawsuit will improve the quality and speed of the negotiations. It does clearly define the stakes of dithering around, that is for sure. Legal proceeding can take a long time.

It might be prudent for all parties concerned to get the pipe out of the hole in the meantime and get this well happening. It would be much easier to settle things for everybody if the meters were not ticking negatively for everybody.

The price of Natural Gas will in all probably be drifting higher in the meantime and the stakes will be raised further.

Taking the proceedural step of making a formal claim in court may be exactly what is required to make the insurance folks aware that people are not just engaged in a pissing match.

We should all be aware that Judges often look out the window before they bring down a judgement. Which means that there are certain political considerations involved in court decisions.

What we need to keep in mind is that there is a large resource of Natural Gas downhole and a whole lot of shareholders uphole with a lot of money invested in getting the gas out of the hole and off to market.

THe drilling contractor had to know that his job was to create the access to allow that to happen. The supplier of the drill pipe has a responsibility to be sure that what he is suppliying is suitable for the task involved amd free from defects.

I was once upon a time involved in the specification and sale of material handling equipment and power driven devices of all kinds.
It is fairly standard practice to apply physics and mathematics to determine the stresses, loads and possible shocks involved in the operation of the equipment and then build in a safety factor of five to ten. Good design makes it impossible to twist off driveshafts. Drive shafts that are not up to spec, have flaws or deficiencies are the exception.

Obviously when you are drilling 25,000 feet deep, each and every section of pipe must be of the highest quality. The consequences of a failure 20,000 feet down are obvious and disastrous.

The drilling contractor and the pipe supplier should be standing up and taking full responsibility in this matter at their earliest opportunity.

We as shareholders in this matter took a risk on the quality and quantity of gas in the formation. We should not be picking up the tab or assuming the risks for deficiencies in the responsibilities assumed by other parties.

And we should make certain that the world knows it.
