Does anyone have an idea as to why yesterday's after-hours announcement of a great 2nd quarter isn't moving the stock much this morning? Also, why would Q management choose to pre-announce a great quarter, rather than remain silent and blow everyone away on the scheduled release date, as they have in the past?

*The Trial* JGoren seems right that with a court result [in Q! favour] or negotiation of a solution, Q! stock price would react VERY favourably. Ericy stock would also rise [much less because CDMA will remain a smallish part of their business].

But in the long run, Q! is not suffering much by delays and there is always a chance that an OJ decision would award the patents to Ericy. Courts are made up of ignorant people who are more like chimps than humans, check their DNA = 99% chimp. Ask them to concatentate some wave functions and see what you get. Many people on juries can't learn a road code, so they won't be able to figure this one out. Even with an advisor, a judge would usually be in a similar position.

The delay does benefit Ericy because it slows the inroads of CDMA. China is sitting tight until the 3G questions are resolved. There are other factors making China wait, such as the PLA ownership of telecommunications. Meanwhile, Ericy can go on selling heaps of GSM equipment. The loser in these delays is the taxpayer/consumer, as usual. Q! is also losing in that those consumers could be buying cdmaOne right now.

However, as Ramsey says, the delays are giving Q! an increasing competitive advantage. Ericy is running some fake 'trials' using VW40 while Q! has got cdma2000 based on real technology readying for sale. Meanwhile, Ericy sits on zero market share in CDMA. Q! is racing ahead, with MSM3100 coming up and MSM3000 proving a great success. They have IBM Silicon/Germanium chips under investigation too which will fit nicely into an Anita [TM] powerful little notebook multifunctional WWeb computing device.

Ericy might end up as a telecommunications curiosity if delays continue long enough. There are plenty of companies working in CDMA, with Q! pre-eminent [other than in terrestrial infrastructure]. There is no particular worry if another competitor doesn't make it to the race. The track is crowded already. The upfront Ericy royalty payment would be nice and it would introduce more capital to telecommunications, which would increase ASIC sales, royalties and the rate of CDMA development.

So either way is no big problem for Q! - delay is no major worry and early agreement or court decision [barring an OJ decision] is fine too; preferable really. From Ericy's point of view, delays have been fine, until now - GSM sales have been healthy and cdmaOne sales comparatively small. But delays now must be making them panic. If they can get an early OJ decision, they would be shrieking with maniacal laughter. If they get a normal, sensible court decision they will have lost nothing since they had nothing. If they can get an early agreement from Q! they can at last get seriously into trying to create and sell some WWeb systems based on Q! technology.

But imagine this; the court throws them out and Q! denies them a licence to use Q! property. Then, Q! licenses many other companies, who have been prepared to pay the cdmaOne fees, to produce WWeb technology. Nokia will be in, Lucent, Motorola, Philips, Nortel, Hyundai, Samsung, LG, Maxon, Fujitsu, Sony, NEC, and all the others will be racing too. The list is very long and more than enough to provide all the equipment subscribers will want.

Ericy will fill out some GSM legacy systems until they are overlaid to WWeb by their competitors [or even cdmaOne in a final indignity]. Then Ericy will have to wind their operation down and focus on switching or other electronic gizmoes.

PS: *OT* Plenty of people prefer not to live in the USA despite the fact that the USA produces a vast array of technology, is one of the wealthiest countries and people enjoy a tolerable level of civil rights though freedom is honored more in song than reality.

A friend from Peru won't live there [has done for some time but now he and his American wife live in Italy]. Another has gone back to India although enjoying a high income as an electronics/computer engineer in the USA. I prefer New Zealand [in summer, but might adopt migratory patterns to San Diego, Port Douglas, Hawaii, Fiji, Le Lavendou [France], Dubrovnik, Greece or somewhere in winter. Dreams can be fulfilled in a lot of places. The USA isn't the only one where dreams can happen. Of course, being one of those rose-coloured wallet types, your dreams are more narrowly defined.

Many Americans have followed their dreams and now live in New Zealand. While Americans can justifiably be very proud of their country and the achievements of many people who live there, it is fraught with problems and is closer to Rwanda than Utopia on the scale of life. Nevertheless, The New Paradigm mostly started in the USA and is continuing there. For which I remain grateful and long may it continue.

Oh yes, for those thinking I'm racist against court people, Chinese and Italian DNA is 99% chimp too! So they are in good company. My DNA is NOT chimp - more like gibbon.
