reporting now on CNBC. Lary and Bob from dowjones news wire.

Lary gave a good three minutes to CKFR.

Mentioned he doesn't understand why INTU would sue a company that they own a 20% of.

Said improving profitability. profits are up. yada yada....

Also made mention of lehmans downgrade. but said it's likely part of the suit.

As a critical part of this agreement, CounterINTUITive <sorry, I refuse to call the company by its rightful name> and Checkfree also agreed to certain "exclusivity" terms. For example, for up to 30 months, CounterINTUITive could not distribute bills originating from Transpoint. In addition, CounterINTUITive agreed that it would not provide bill payment processing services to merchants. For the same 30 month exclusivity period, Checkfree ceded to CounterINTUITive the "exclusive right" to i) provide the CounterINTUTive bill presentment services for all bills "originating or passing through Checkfree" on certain internet web sites, known as Web Consumer Aggregation Channels, and ii) to "make available" billpay services on the Web channels "whether provided independently or coupled with bill presentment services."
