Art, this nomenclature can refer to something else.

It has to do with whether a brokerage maintains an inventory of a stock and can be filling customer orders from this inventory. In other words, whether or not a brokerage owns a specialist firm or MM operation, it can still *act* as a market maker and fulfill customer orders from its own inventory. The "we make a market" disclosure is merely the disclaimer that confirms this.
