That is exactly what my intention is, to open each position
seperatly, not for tax issues whatsoever, but purely to
use this strategy to minimize loss, maximize gain.

In fact, I didn't think two separate positions, long
and short "could" be opened any other way but separately.

Is this strategy much different then an arbitrage position,
when you buy the stock of the company with the greater value
in a stock swap. Look at MENS and SUIT for recent example.

As each is a separate transaction, the customer should have
every right to initiate both long and short positions, esp.
before events that could move the stock dramatically up or down.
Don't people buy puts as a hedge against a long stock position.

In any case, if one wanted to, one could Short a stock here,
then long it in an offshore account, or is that against NASD regulations too<g>.
