I would have to see how the pleadings and settlement papers were structured, but compensation for employment discrimination is subject to taxation depending on the circumstances. Don't rely on my memory, but what I recall is that if it is for physical injury, it is non-taxable, otherwise, it is taxable. I believe compensation emotional injury without physical injury is taxable. There was a recent U.S. Supreme Court ruling on this.
