Yes, I would agree that the shares to be issued for the "patent payment" would have their price based on the market price "on the trading day before the application was made", or on the 10 day weighted average prior to the application being made. The timing of the application is determined by the insiders. With the aforementioned selling by a certain house, one doesn't have to have much of a conspiracy theorist bent to say "it sucks".
