Johnd, Settlement--that was what i was thinking after reading the same story that you had posted. I agree with you 100% and have the exact same feeling. There might actually be some added pressure on both parties given the Intel settlement. That is, it makes the FTC and INTEL look more professional in my opinion. I think the DOJ and MSFT don't want to appear to be the opposite (big bad Microsoft versus big bad government).

The following sentence is a good hint:

Smith said that he would not comment on whether any negotiations were underway.

He could have easily stated that there were no negotiations if there were actually none. However, short of saying they were negotiating---he actually implied it by refusing to comment!!!
