By Amex rules QQQ can be shorted on the downtick.
Whether it was implemented by Datek -- ?

Datek used to have this right. I've shorted SPY many times on the downtick with them, but haven't traded that instrument in quite sometime, so I can't speak for recently.

There is one disadvantage to trading the Amex index trusts through Datek. These are open for trading on Amex until 4:15, but Datek cuts you off at 4:00, unless they've changed this policy.
