Well, my friend, this is true for virtually any general crime. If you ask people if stealing is a crime, they likely will say that it is. If you then ask them if a thief should get 10 to 20 years for stealing, they may say that he should not. If you tell them the thief was wealthy and well fed and yet stole from a starving man, then many will say he should get the 20 years/ If you tell them the starving man had stolen from a starving child then the people may say the wealthy thief should not do time.

We should not confuse the punishment with the principle of the thing. We should first determine if stealing is criminal. Then and only then should we set up punitive measures based upon mitigating factors.

Well you put it like this and you should lose. I do not advocate "prosecuting women as criminals" (dear me, try arguing the point). I advocate we determine the principle of the thing and then together reason over the punitive measures just as we have done for every other crime.
