Don't Lie: 'Retired Guard Officer Indicted In Sex Case'

SPRINGFIELD, Ill., March 11—The Illinois Army National Guard's former chief of staff has been charged with using bribes and lying under oath to thwart an investigation into his alleged sexual misconduct.

Col. James M. Burgess, recently put on retirement status from his $102,907-a-year post, could spend up to 85 years in prison and be fined $2.5 million if convicted.

The 10-count indictment Wednesday charged him with obstruction of a proceeding, two counts of perjury, two counts of bribery, three counts of witness tampering and two counts of false statements.

It alleges he engaged in the illegal acts during an investigation into sexual harassment and adultery by the Washington-based National Guard Bureau, and subsequent investigations by the Army, the FBI and a federal grand jury.

One of the perjury charges alleges Burgess lied when he said, "I'm not interested in any other woman than my wife. And especially if they happen to work for me and they happen to work here."

Burgess, 52, was arrested Wednesday. His arraignment and custody hearing was delayed until Friday. Prosecutor Patrick Chesley said he intends to oppose releasing Burgess on bail because the law allows people to be kept in custody when they might obstruct justice or influence witnesses.

"We're extremely surprised and upset the grand jury returned an indictment," his attorney, Jon Noll, said.

The probe initially looked into allegations that Burgess committed adultery, harassed female employees and was engaged in an "improper relationship," according to the indictment.

The grand jury concluded that not only did Burgess try to thwart the investigation but that he had attempted to cover up misconduct.

The indictment cites repeated statements Burgess made under oath to a military investigator in 1997 in which he denied any sexual harassment. According to the indictment, Burgess "repeatedly had sexually harassed, touched in a sexual manner and made improper sexual advances toward females."

I had slept some during the day, so I was wide awake. I found a great sight that allowed me to find Biblical passages by using key words like "womb" or "wrath"! I didn't bookmark it, but it comes right up if you do a search on Metacrawler...I just wanted to get Johnathan Doe's reaction to the first set of passages, since he says he is an Evangelical, but pro- choice, then I got the bright idea of showing that, contra Schuh, being disgruntled with a corrupt ruler is not "un-Christian", as he was taunting Johannes, Dwight, and some others yesterday.
