U.S. Justice Dept permits AOL to buy Netscape

WASHINGTON, March 12 (Reuters) - The Justice Department on Friday permitted America Online (NYSE:AOL - news) to acquire Netscape Communications Corp. (Nasdaq:NSCP - news) and enter into a strategic alliance with Sun Microsystems Inc (Nasdaq:SUNW - news).

'The division has decided that it will not challenge the transaction, having concluded that neither the merger nor the alliance violate the antitrust laws,'' said the Justice Department in a statement. The Microsoft Corp. (Nasdaq:MSFT - news) has said that the deal makes irrelevant its trial on antitrust charges brought by the Justice Department and 19 states.

''Obviously, we're pleased and look forward to the Netscape shareholder meeting on the 17th of March,'' said Jim Whitney, a spokesman for AOL at its headquarters in Dulles, Virginia. A Netscape spokeswoman referred calls to AOL.

Witnesses from AOL, Sun and Netscape all appeared as witnesses for the government at the Microsoft trial, which is in recess until next month or later.

Netscape has been the centerpiece of the government case against Microsoft. The government alleges that Microsoft used monopoly power in the market for its Windows operating systems to compete unfairly against Netscape.
