I think your question is whether it should fall under the jurisdiction of the executive or legislative branch.

In an earlier post, you commented "Wish we could depend more on principles and laws and less on particular men." There is certainly a great deal of merit in that wish. But then I look at the Fed and Alan Greenspan. Would we have enjoyed this era of prosperity and economic growth were it not for the will and steerage of one man over that bureaucracy? Likely not, IMO. So, I guess the particular men thing works for me........... as long as I benefit, that is. <g>

If I recall correctly DMA...this was delegated by congress to the FCC and on occasion there are hearings from time to time for reports to congress. The majority opinion is to maintain the free idea so as to grow the Internet so everyone has access and not to stall the economy which is being fueled by it. There is no doubt congress can step in and make changes anytime it's politically safe to do so.

The Director almighty attitude displayed by the guy is what I find inappropriate.

Kennard has done an excellent job "bureaecrat" or otherwise! IMO I would much rather have 1 bureaucrat(who incidentally has proven in the past that he is capable of making intelligent, rational decisions, than to give it to a bunch of politicians in congress, who have proven,time and time again, that they are incapable of making even minor decisions, with even a slight possibility of getting it right.
Of course, then we would have the so called "campaigne contributions" to further complicate things. My recommendation to congress, is they use their extensive medical coverage plan, which would cover the costs for all members to have an "optical-rectumical insertion." What kind of operation is this: It's the insertion of a little window where their belly-button is so that when they're all running around with their heads up their a.., they can see where they're going!
