THen, efaxinc has to sue a lot of companies or may be contersued by other "fax" companies. Fax is a general term and not copyrighted as far as I know.

And, as far as I know, it's a matter of exact wording whether it can be confused.
IFLY had a quarrel with its 1-800flyforless (or one of the other 800s) back in 1998 per a 10-Q. It didn't materialize, so far. And as for IFLY the effect on the stock price was small.

Good point.

Is efax going to be like Kleenex and Escalator, both brand names that are used generically? I think both the brand names above are far more unique than efax, and uniqueness and differentation are key for legitimate trademarks.
