Thanks Paul, I do not think the SEC is involved, currently floorless strategies used by "floorless bandits" are as legal as buying and selling strategies used by SOES bandits. The difference is that the SOES bandits take on real risks, while the floorless bandits arrange the situation to be in many cases risk less. I should mention however that some of the floorless bandits in the case of CTYS were unable to get their whole position hedged in time and they ate their own "petard". Thus even florless bandits can face normal market risks.
