Back when the monkey was ~$6, CKFR bought back and retired a large chunk of the float. This effectively increased INTU's share to over 20%. INTU was forced to sell shares at under $10 to lower their stake to under 20%. The 20% is an SEC rule.

I think if INTU had the chance to buy more CKFR below $10.00, they would own more as well. I guess the lawsuit was a failed attempt.
