I'll jump in on both sides of this arguement :)

They used the funds from the sales of shares for shorting the stock

If they did, they didn't do it very well. The stock has never been a significant number of shares short. It's seen as bit too volitile for shorting successfully.....

It is indeed illegal, so the statement you made would have to be false. Otherwise, the insiders who shorted the stock would have been busted by the SEC

Lets see now, everyone who violates the law is always caught....NOT :)
