You're right....I think it's the same issue now, but the Fed is more powerful now......

Under the National Banking Act of Feb. 25, 1863, the United States Bank Notes were declared legal tender "for taxes and duties"......for this reason they were also generally accepted by the public as money. They were not declared legal tender for private transactions.

Now the Federal Reserve Notes are legal tender for all transactions, public and private!!!
