He already has effective control since, when the non-tender parts of the deal are complete, he will, apparently, own more of the company than anyone else. If he wants more and doesn't get it from this tender offer, then he'll have to revise the offer, but the fact remains that the offer he put on the table yesterday did accomplish a significant goal: It guaranteed support of the bid by holding prices higher. If anyone else (like, say, his partners across the lake in Redmond) had contemplated a competing deal, the tender offer probably helped them decide against it.
