[Litigation] could lead to [Nullsoft's] acquisition by a third party

I would be interested in your reasoning process, Marlow? While it may increase Nullsoft's desire for a deep pocketed parent, Nullsoft's value as a potential target has been substantially reduced.

Facially, PlayMedia's [PM's] claim sounds like it has merit. It's credentials, at least, appear impressive. If PM prevails, Nullsoft's technology might not be worth much and PM would instead be the prime acquisition target.

Litigation creates uncertainty that tends to cast a pall on acquisitive activity, unless, that is, the potential acquiror might be in a better position to offer the plaintiff something it wants in return for a settlement.

I suspect PM by this suit may be putting itself in play, telling the world that if you want the player, we are the one you want, rather than Nullsoft.
