If you read the ABER News Release you will see that ABER is not argueing that they did not get notice. They are claiming that they had notice and they reported such in their 3rd quarter, they attended the meeting with Winspear and even claim in the NR that they intended all along to participate.
What they did not do was put their intentions in writing as required by the JV contract and send money.
