The agreement only allows them to withhold when an injunction is sought blocking chip sales. It's ugly legalese, but check out the language (emphasis mine):

"any obligation..shall be inapplicable..unless that customer agrees in writing not to seek an injunction... [Intel] shall not take action prohibited in this Paragraph II.A. for the reason that such customer is seeking or has sought compensation, damages or any other legal or equitable remedies other than injunction as herein provided."

In re EV6 bus, it is better than Intel's. I hear Compaq and AMD will share motherboards to defray the cost -- and to help Compaq promote Alpha, which uses the same bus.
