I just got off the phone from speaking with CPQ IR. Here are my questions and the answers:

Q: I was informed last week that CPQ can not talk to individuals or institutions during the quiet period. Can CPQ talk to say, an analyst from ML?

A: No, we can not talk to analysts either.

Q: During my previous call I was told CPQ could issue an earnings warning in a news release . Can it make a news release if it expects to exceed earnings estimates?

A: Yes.

Q: Going with this, can it make a new release if it expects to meet earnings?

A: Yes.

Q: Can you make a news release commenting on the .20 estimate made by that guy at PJ this morning?

A: No, our hands are tired. We are bound by SEC regulations during the quiet period and we would be in violation if we were to make any commentary.

The IR person said this analysts has pulled this same thing before, not just on CPQ but on other companies as well [coming out with an earnings estimate change during the quiet period, when the company can not say one word]
