Meantime this Globe article confirms for the first time that the payment of funds deadline was in fact missed, so that is a new poece of info in the public domain.

Sorry Lorne, you may have been watching too many soaps.
With regard to business, the main function of the courts is too enforce contracts and collect debts.
If the question that you want answers to is addressed in the contract, then you already have the answer. The contract defines the rights, responsibilities, and obligations of both parties and in this case the consequences.
You are estopped from argueing that your own agreement is "unfair" or "inequitable".
A suit in court alleging such matters falls into the nuisance, frivolous, and vexacious category and is subject to an assignment of multiple costs against the plaintiff.
