I've recently subscribed to SI. Over the past several months, pre-TSC article, I was challenging CYOE on the Yahoo! board (same handle)to answer valid questions raised by their obviously hyped, informationally deficient PR. Their bouyant PR persona and spending was at odds with the reality checks of their SEC filings.

Re: Systeam, CYOE's filing stated that they may suffer a "material adverse effect" if the Systeam deal is not conmsummated. Normally a MAE is legalese for some substantive negative result, so how can NOT doing such a deal be so material to their existing business? Odds are CYOE either has a breakup fee payable to Systeam if the deal is not (was not) consummated or CYOE will have accounting issues due to some as-yet undisclosed, squirrelly deal with Systeam. Either situation could put CYOE under at this point and THAT would be a MAE.

Based on their past PR proclivities, if CYOE did consummate or even if they merely got an extension, such "news" would've been on the wire before market open this a.m. No PR from CYOE means nothing hypeable and that is bad if you're long.
