Aber's percentage interest in the Camsell lake program is only maintained by their participation. They are not the poor widow of a coal miner who is being heartlessly evicted from a company house by a coal baron.

Winspear as operator, drew up the 1999 winter exploration program and submitted it to Aber. They had a meeting to discuss it and hear any suggestions or objections.

Aber, according to the JV contract, may elect to participate or be diluted. They have X days to notify Winspear of their intentions to participate.

If Winspear does not receive notification they may proceed an the basis that Aber is not participating, and Aber % interest in the project based upon contributions is reduced.

The percentage interest in the project is only maintained by participation.

It is not as if Winspear has acted capriciously. Aber choose their own course of action and the consequences are spelled out in the contract.
