<INCY doesn't even mention the possibility that whole-gene sequences may be unpatentable - it does say that there are uncertainties and risks about the patenting of partial-gene sequences, about overlapping patents issued to others and possible expensive interference proceedings and litigation, etc.>

That is very interesting, and seems to be the prevailing view of all the patent stuff posted in the recent flurry on the subject. This seems to be what you'd place your chips on, that at least the full gene sequences are safe.

< INCY would still have rights to royalties on drugs developed under the terms of the (1000's of) licenses big pharmas had signed earlier with INCY.>

Yes, and I think something that gets lost when looking at this issue on its own instead of the dynamic world in which we live is very important: What Big Pharma is going to wait around or nickle and dime while waiting for this to play out? No one. Is Big Pharma going to try and drive tough bargains with INCY due to this?? "Well, yes put your proposal in my in-box behind the other three guys with dribbling pipelines if you will." Good Luck. Is Big Pharma going to license or develope something they may no have the rights to just to save a few million bucks? No Way. To sum up... life goes on, this will play out in the long run, but in the mean time who knows how long we'll float around with this issue unresolved... years for sure. And if you stay out of this sector because of that uncertainty it will undoubtedly keep growing without you. Thats life.

Bought more yesterday... time will tell.
