And we will all notice the optimum words in that statement are lying and failing. They say nothing about an investor or poster stating their own personal opinions about a stock. At least that is my read on it. I agree with your reading. But there are gray areas. What about somebody who says "Talked with the CEO. In my opinion, the contract with BIGCO will be signed Friday. I believe it will be for first revenues of about $15 million." The guy really did talk with the CEO, about something totally different. All the rest is made up, but it's his "opinion." Is this lying? Is this failing to disclose a relationship? Not easy questions! (Trust a lawyer to ask that kind of question!) The SEC has its work cut out for it. My assumption is that they will be going, for the time being, for clear cut violations -- will want to establish a track record, get some favorable case law from easy cases, and make some people nervous. Will be interesting to see if it works.
