I am sorry in my prior post to you I said that OAC was a RIC, it is a REIT. But they can still pay a dividend through the tax return filing date relating to the prior year. The same type of rules apply. Internal Revenue Code Section 858..

I think that if the company did not pay the dividend the tax liability would be substantial relating to 1998, penalties and interest too. They will pay the dividend. Either way they will need to raise some cash. Paying the dividend provides shareholder value -- paying the tax does not.
